These Terms of Service ("Terms") govern your use of services provided by Bag Carriers LLC ("Bag Carriers," "we," "us," or "our"), including website design, hosting, maintenance, portal access, and related services purchased through any Bag Carriers operated checkout, including bagcarriers.com and any client subdomain operated by Bag Carriers (collectively, the "Services"). By enrolling, signing an enrollment agreement, or paying any fee to Bag Carriers, you agree to be bound by these Terms.
Bag Carriers provides website design, build-out, hosting, maintenance, customer-facing portals, and optional payment integration for small businesses. The specific scope of services purchased is described in the signed enrollment agreement applicable to your account.
A one-time setup fee is due at kickoff. The amount is stated on your enrollment page and signed enrollment agreement at the time of purchase.
A monthly retainer covering hosting, maintenance, and ongoing support begins on the agreed go-live date and renews monthly. The amount is stated on your enrollment page and signed enrollment agreement. Bag Carriers may adjust the monthly retainer with thirty (30) days written notice.
All payments to Bag Carriers are processed through NMI, our PCI-compliant payment gateway. Card data is tokenized at entry and is never stored on Bag Carriers infrastructure.
If a monthly retainer payment is more than seven (7) days past due, Bag Carriers may suspend the Services until payment is received.
You may cancel the monthly retainer with thirty (30) days written notice to frank.lechner@bagcarriers.com. Refund eligibility is governed by our Refund Policy.
You warrant that all logos, photos, copy, and other materials you provide to Bag Carriers are owned by you or properly licensed for use, and you indemnify Bag Carriers against any claim arising from materials you provide.
You agree not to use the Services to host, distribute, or process unlawful, fraudulent, or infringing content. Bag Carriers may suspend or terminate Services that violate this section.
Bag Carriers does not sell or share your customer data. See our Customer Privacy Policy for full details on how we collect, store, and protect data.
Bag Carriers targets 99% monthly uptime. Support inquiries receive a response within one (1) business day, Monday through Friday. Critical outages affecting payments or site availability are prioritized.
AI agent add-ons (including but not limited to the AI Quote Agent, Invoice Chaser, Google Review Responder, Content Developer, and SEO Optimization) are designed to assist and accelerate business workflows by drafting quotes, follow-ups, replies, content, and similar outputs. They are tools to help speed up your processes — they do not replace human judgment.
AI-generated content may contain errors, omissions, or inaccuracies. By enabling any AI agent add-on, you acknowledge and agree that:
You may disable or remove any AI agent add-on at any time with thirty (30) days written notice to frank.lechner@bagcarriers.com.
To the maximum extent permitted by law, Bag Carriers' aggregate liability for any claim arising out of or related to the Services is limited to the amount you paid to Bag Carriers in the twelve (12) months preceding the claim. Bag Carriers is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Blair County, Pennsylvania, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated via email to your account contact.
